Rental Agreement

This Rental Agreement (“Agreement”) is made between Beach Day Rentals (“Owner”) and the renter, effective as of the date of acceptance.

1. Rental Items:
‍The Owner agrees to rent the items specified in the confirmation email and/or photo documentation sent at the time of delivery. By accepting the delivery, the renter acknowledges and agrees to the stated value of the delivered items.
• Beach cart: $150 value each
• Yeti Cooler: $300 value each
• Yeti Cooler Cups: $150 value each
• Beach Chairs: $40 value each
• Beach Umbrella: $50 value each
• Frisbee: $20 value each
• Volleyball: $20 value each
• Water-ball skipper: $10 value each

2. Rental Period: The rental period will be as agreed upon by both parties.

3. Rental Fee: The rental fee will be determined based on the length of the rental period. A hold will be placed on the renter’s credit card for the total value of all items rented.4. Condition of Items: Items must be returned in the condition they were received, accounting for normal wear and tear. The Yeti Cooler may only be used for holding food and beverages. It is strictly prohibited to use the cooler for bait, tackle, or any other non-food/beverage items.

5. Loss or Damage: If any items are not returned or are returned damaged beyond normal wear and tear, the renter’s credit card will be charged for the full value of the item(s) as listed above.

6. Pickup and Return: Pickup and return of the rented items will be coordinated between the owner and the renter. Failure to return the items at the agreed-upon time will result in an additional charge of $50 per hour and, if not returned by the end of the day, a charge of the full day’s amount plus 25% for each additional day the equipment is not returned.

7. Cancellation Policy: The renter may cancel the rental with 48 hours’ notice. If the renter fails to provide 48 hours’ notice of cancellation, they will be charged the full rental fee. The $50 deposit is non-refundable.

‍8. Liability: The renter acknowledges and agrees that the use of the rented items is at their own risk. The renter releases the owner from any and all liability arising out of the use of the rented items.

9. Jurisdiction: This Agreement shall be governed by the laws of St. Pete Beach, Florida, USA, and any disputes arising from this Agreement shall be resolved in the courts of St. Pete Beach, Florida, USA.

10. Entire Agreement: This Agreement contains the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties.By selecting “Yes” on the booking page, the renter acknowledges that they have read, understood, and agreed to the terms and conditions of this Agreement.
